Rational individuals trade through bilateral contracts on open markets until the costs of transactions mean that using corporations to produce things is more cost-effective. Ancient India and China represent distinct traditions of law, and have historically had independent schools of legal theory and practice.

Levi noted that the “basic pattern of legal reasoning is reasoning by example”—that is, reasoning by comparing outcomes in cases resolving similar legal questions. The most familiar institutions of civil society include economic markets, profit-oriented firms, families, trade unions, hospitals, universities, schools, charities, debating clubs, non-governmental organisations, neighbourhoods, churches, and religious associations.
